
Late-night television has faced significant challenges in recent years, exemplified by ABC’s repeated considerations to cancel Jimmy Kimmel Live! Two key factors stand out: declining viewership amid competition from streaming services like Netflix or porn – people flee these one note late night Trump Deranged hosts. But the violent rhetoric continues non-stop. In response to this rhetoric that has clearly incited violence, it is past time we actually have a justice system that has the courage to use 18 U.S. Code § 373 that states:
“Whoever, with intent that another person engage in conduct constituting a felony that has as an element the use, attempted use, or threatened use of physical force against property or against the person of another in violation of the laws of the United States, and under circumstances strongly corroborative of that intent, solicits, commands, induces, or otherwise endeavors to persuade such other person to engage in such conduct, shall be imprisoned not more than one-half the maximum term of imprisonment or (notwithstanding section 3571) fined not more than one-half of the maximum fine prescribed for the punishment of the crime solicited, or both; or if the crime solicited is punishable by life imprisonment or death, shall be imprisoned for not more than twenty years.”
Despite these issues, shows like Kimmel’s persist, often prioritizing political propaganda over entertainment. Kimmel’s persistent comparisons of Donald Trump to Hitler and fascists have drawn scrutiny, especially in light of events like the two assassination attempts on Trump and the tragic shooting of conservative activist Charlie Kirk in September 2025 at Utah Valley University. While direct causation is debated, such language has fueled heated social media division. This repetitive propaganda equating Trump to Hitler – is walking the fine line between “free speech” and inciting violence.
When the outcome to this propaganda from the left is one violent attack after another: Scalise shot, two assassination attempts on Trump, Trump shot, one bystander killed, and culminating with the assassination of Charlie Kirk, I repeat, it is way past time to invoke 18 U.S. Code § 373. But where is the political will in a “free society” to say – yes, there is a limit to “free speech”. The Marxist left and Globalists have had no problem censoring conservative social media – and lying about Trump’s connection to Russia or the egregious 51 “experts” that lied that Hunter’s laptop was Russian disinformation. But conservatives must have the will to invoke the law that would curtail those on the left that have no problem emulating the Stalinist or Maoist regimes that use violent rhetoric and surrogates who actually pull the trigger to intimidate their opposition.
Winston Churchill’s from his 1938 speech at Bristol University gives us the traditional view of freedom of speech in a civilized society:
“I judge the civilisation of any community by simple tests. What is the degree of freedom possessed by the citizen or subject? Can he think, speak and act freely under well-established, well-known laws? Can he criticize the executive government?”
This quote underscores a core principle: true civilization thrives on free expression under the rule of law. Conservatives, including Trump supporters, generally welcome policy critiques but draw the line at relentless personal attacks that border on incitement. We are, however, no longer in the realm of free speech in a civilized society. We are firmly in the world of an undeclared Civil War. But it resides in a never never land where both sides are too timid to admit it exists.
If Trump were the authoritarian figure portrayed, critics like Kimmel, Stephen Colbert, and others would likely face suppression that would keep them off the air permanently —yet they continue broadcasting, even after Kimmel’s brief suspension in September 2025 following backlash over the Kirk incident. These hosts often serve as advocates for progressive elements within the Democratic Party, pushing for leaders like Alexandria Ocasio-Cortez (AOC), Rashida Tlaib, and Ilhan Omar—who advocate for significant shifts away from America’s founding principles, or like the newly elected Marxist anti-Semitic mayor of New York – Mamdani – all in one way or another are echoing Barack Obama’s call for “fundamental transformation” of America. Networks may tolerate financial losses from these shows in hopes of influencing future elections toward more moderate Republicans (RINOs) or Democrats.
Critics are no longer simply arguing economic or international policy – they are actively inciting riots and violence. Yet mainstream media often downplays positives while amplifying negatives, raising questions about balanced reporting. The overuse of “democracy” by critics misrepresents our system: The U.S. is a constitutional republic with checks like the Electoral College, designed to prevent mob rule. We must strive for the civilized society Churchill envisioned—one where debate is civil, facts prevail, and freedom endures but it cannot endure when the country is essentially in an undeclared civil war. In 2026, it is time for those that incite violence to be held to account. Invoking 18 U.S. Code § 373 would be a good start.
